Ben Tribbett Files Formal Challenge to DPVA Convention Vote for DNC

by: lowkell

Wed Jun 13, 2012 at 19:00:00 PM EDT

Ben Tribbett has submitted a letter appealing the "election" for DNC representative held at the June 2 DPVA convention. You can read Ben's letter here.

Ben, his counsels, and scores of witnesses agree that the convention was marked by "ballot irregularities, unclear rules and intimidation of delegates as to how they would cast their ballots". However, Ben's appeal is more narrowly "focused on the procedural errors that led to the 'election' of Mr. Wallace." The remedy proposed in his appeal is that DPVA "declare the election of Mr. Wallace invalid since the rules were never suspended at the convention to allow a standing vote, and that the DPVA call a convention at the earliest possible date; at the same location; and with the same elected Delegates; to vote on electing a member of the Democratic National Committee."

My understanding is that, although this challenge process has started with DPVA, the DNC itself may get to decide whether a remedy will be granted, and if so what remedy that might be. Of course, it would be better if this process never had to get that far, and instead could be handled at the DPVA level. The problem is, does anyone believe that the DPVA might actually agree to hold a new convention and a new vote? I certainly don't. Regardless, I think there's a potentially better way to proceed for all concerned.

In short, why not have DPVA call a new vote by caucus, with each Congressional District holding its own in a location accessible to voters in the district? The caucuses should all be held on the same day, for a period of several hours, so that everyone who wants to vote has a chance to do so. The voting could be by preferential ballot (voters rank candidates in order of preference) among the three candidates - Lionell Spruill, George Wallace, and Ben Tribbett - who would have proceeded to the runoff election if the DPVA convention had been handled properly and fairly.

Holding a series of caucuses like this would be relatively simple, would not require people to travel to Fairfax, and would not require DPVA to rent the Performing Arts Center again, at significant cost (not to mention the cost and inconvenience of delegates making the trek once again to Fairfax). Even better, it would help maximize grassroots involvement, as it would be much more convenient for people to vote close to where they live, and to not have to spend several hours (or more) to do so.

Of course, this is probably too reasonable and simple an idea for DPVA, but I thought I'd throw it out there nonetheless. I would just ask, if the fine folks at DPVA don't want to hold a new convention in Fairfax, and if they don't want to opt for the option I've outlined above, then what IS their preference exactly? Would they seriously suggest that this messed-up election be allowed to stand? If so, that will say a lot - nothing good - about DPVA, and specifically about its chairman, Brian "For Profit" Moran.

Excellent Suggestion (4.00 / 1)
Your suggestion for congressional district caucuses is an excellent way to settle this dispute. The party should be focusing on the election of Barack Obama and Tim Kaine, not repeating a state convention. Alternatively, in this time of technology there must be a way to poll the delegates short of a repeat convention.

But the Competence of the DPVA Precludes Confidence (4.00 / 1)
in a process such as that you propose. Actually, the confusion within the district caucuses at the convention argues that disorder would be the order of the day in this arrangement and there is no way to guarantee consistent application of the process.

Those who were delegates already invested a great deal of time, effort, and money for the opportunity to participate at the convention. Many of them are going to be disenfranchised by any arrangement now, particularly those who were credentialed and assigned to districts other than their own.

I offer no altenative solution and would be satisfied with yours if it were offered. But nothing can replace the integrity of a properly executed vote that should have been assured at the convention had we a competent DPVA.

True, but now that a "properly executed vote" has not taken place (4.00 / 1)
we have to move to Plan B (or C or D), or simply settle for the illegitimate outcome.

We'll have to settle for the outcome from the convention (0.00 / 0)
Sorry, there's no way to have another convention, and the district idea would be difficult as well.  Delegates have already given up a couple of Saturdays to the cause, I seriously doubt they will give up a third.

What could be done is for George to resign, and then have the seat filled by the prescribed method, which would probably be a vote by state central.  George could run again, as could Ben and Lionel and anyone else.  This could happen at the September meetings.

Not Acceptable (0.00 / 0)
We're talking about a spot on the Democratic National Committee - the central committee of our party.  What the heck does it say about our party if one of its central committee members got his spot because the state party couldn't figure out how to run a convention with multiple ballots or how to explain to delegates what the heck they're voting on?  I'm sure George Wallace is a nice guy and he may well make a great DNC member, but seating him based on this disaster and calling it a fair election would be an embarrassment to the Democratic Party.

So how acceptable (0.00 / 0)
is it to expect thousands of delegates to give up more of their time and money to attend yet another convention?  Even at the CD level, that could mean a full day with travel, since a lot of Virginia's districts are pretty large.  All of this for a vote on a position most know very little about and probably don't care that much about in the first place?

Another option would be to use good old snail mail and send out a ballot to everyone, with instant runoff.  Everyone stack ranks the 3 or 4 candidates and then sends it in.  Even that would cost thousands of dollars though, and take a week or two to accomplish.

How about a secure vote online? (0.00 / 0)
That would take almost no time for delegates, cost them nothing, and give us results almost instantly. Or is that too logical and 21st century for DPVA?

You still need to mail out the login info (0.00 / 0)
passwords, all of that.  Not everyone uses the internet, but everyone gets real mail.

That a Great Option, But Knowing the DPVA (0.00 / 0)
It would require much help from outside the organization to pull it off anytime before the next quadrennial  convention. I doubt that the DPVA has the dataset required to contact and verify every delegate entitled to vote.

[ Parent ]
Not sure that would work (0.00 / 0)
I doubt the DPVA has the address of every delegate that attended. I know they don't have mine. I have avoided giving out my mailing address to any political organization to cut down on wasteful paper campaign material being sent to me.

[ Parent ]
There are options (0.00 / 0)
There are ways to do this fairly.  Mail would work, or they could simply send the ballots to every county-level democratic committee and say "delegates, if you want to vote, go there".  Yes, it's a hassle, but that's all the more reason they shouldn't have messed it up in the first place.

[ Parent ]
The problem with mail (0.00 / 0)
Is that DPVA was NOT tracking everyone who signed in that day, they were just throwing badges at people towards the end of sign ups.  If they had been organized they would have a complete list of people who attended and would have this option.

[ Parent ]
What? (0.00 / 0)
I'm sorry, are you serious?  We don't even know WHO ATTENDED the convention?  I would have thought that was a baseline thing that couldn't be screwed up.

the Chairman's control of the room... (0.00 / 0)
Wow... after watching that... good thing he was never Speaker!
