Herring: Obenshain Not Honest About His Miscarriage Bill

by: lowkell

Thu Jun 13, 2013 at 16:00:30 PM EDT

From the Mark Herring for Attorney General campaign, this press release references Republican AG nominee Mark Obenshain's appearance on the John Fredericks Show earlier today. In that appearance, Obenshain claimed that he pulled the bill because it was "too broad." In fact, what's really going on here is Obenshain trying to rewrite history, change the narrative away from one that is damaging to him to one that's more favorable - albeit untrue. Nice try, but no cigar as the saying goes...
Leesburg - Democratic nominee for Attorney General State Senator Mark Herring (Loudoun and Fairfax) issued this statement today following comments made by Senator Mark Obenshain on the John Fredericks Show this morning in regards to legislation he sponsored that would have required women who suffer a miscarriage to report it to the police:

"Mark Obenshain is not being honest with voters. His bill would have treated women who suffer through miscarriages as criminals. It was so extreme that he had to pull the bill because of a firestorm of opposition.

"And Obenshain knew exactly what he was doing when he introduced the bill. He saw just a few sessions earlier the outrage caused by a similar bill introduced in the House of Delegates.

"Mark Obenshain knew what he was doing - pandering to his extreme base so he could make it through the same convention that nominated E.W. Jackson for Lt. Governor. Obenshain's record of attacking women's health through his career couldn't be more clear."

Didn't Obenshain patron this bill two years in a row? Good at lying- bad at AG-

Here's the relevant part of Obenshain's crazy bill (0.00 / 0)

Basically identical to Del. John Cosgrove's 2005 (0.00 / 0)
bill, which stated:
When a fetal death occurs without medical attendance, it shall be the woman's responsibility to
report the death to the law-enforcement agency in the jurisdiction of which the delivery occurs within 12
hours after the delivery.
A violation of this section shall be punishable as a Class 1 misdemeanor.

see Legislative Sentry: HB1677 - Have Miscarriage, Go to Jail?, by Maura Keaney.
Imagine the following scenario.

You are at home alone at 8:00 on a Friday night.  You are 8 weeks pregnant.  You are excited about the pregnancy, but being cautious, you haven't told anyone about it yet except your partner, your best friend, your parents, and your doctor.

All of a sudden, you begin to experience heavy cramping.  Bleeding ensues.  You realize with shock and sadness that you are probably experiencing a miscarriage.  You leave a message with your doctor's service.  The on-call doctor calls back, offers sympathies, and advises taking pain medication or going to the hospital if the bleeding gets worse. She offers you the next available appointment for a follow-up exam - Monday at 3PM.  You accept. You are overwhelmed with grief and surprised by the intensity of physical pain involved. You call your partner and ask him to come home from his "boys night out", sparing him the reason over the phone.  You call your best friend.  She offers to come over immediately and make you cocoa.  You cry.

You decide not to tell your parents yet; let them sleep through the night before delivering the terrible news.  Your partner comes home and you break the sad news to him.  He holds you on the couch and you both cry together.  Your best friend comes over with cocoa.  You cry some more.  Over the next few hours, you suffer pain, cramping, and intermittent bleeding.  Exhausted, you finally fall asleep in your partner's arms around 4 AM.  You sleep until noon, and then gird yourself for the difficult call to your parents, who were so eagerly anticipating their first grandchild.

Guess what?  You just earned yourself up to 12 months in jail and a $2,500 fine.  Why?  Because you failed to call the cops and report your miscarriage within 12 hours.

True?  Not yet.  But if Delegate John Cosgrove (R-78) has his way, HB1677 will become law in a few short months, and this scenario will be reality for many women in Virginia.

Incredulous?  Outraged?  Read on below the jump for more information on this odious bill.

Stories about Maura Keaney's fight against Cosgrove's bill... (0.00 / 0)
...which Obenshain picked up, almost verbatim, a few years later.

See here and here. It's amazing that we have to keep fighting these same fights over and over again with right-wing extremists (Cosgrove, Obenshain, etc.) who want to penalize women instead of help them, tell them what to do with their bodies, etc. Note that these are almost invariably Republican men.

There are some Republican women... (0.00 / 0)
too who agree with these idiots.  I cannot for the life of me think why ANY woman would support these Taliban-like tyrants.  Come on, women of Virginia, we are stronger than they are.

The New MO for the Extremists (0.00 / 0)
Isn't this what is now going on?  These right wing crazies say the most outrageous things, propose outrageous bills against women, gays, other ethnic groups, etc.  They get the media all riled up and THEY GET ALL THE FREE PUBLICITY THEY COULD ASK FOR.  Then, when we are all totally outraged and want to lynch the bastards, they back off and say, "Oh, that wasn't exactly what I meant.  My statements were taken out of context."  They are all doing it and we are, well most of us, crying for their blood.  And the media loves it.
