AG Mark Herring’s Office Announces Nixon Peabody LLP Appointed to Conduct Independent Investigation re: Inspector General and Virginia Parole Board

See below for breaking news from AG Mark Herring’s office. Also, see here and here for some recent thoughts by VA Secretary of Public Safety Brian Moran on this controversy…basically that “We have nothing to hide in the governor’s office…it’s out there, we’ve addressed this numerous times and the sooner we can remove any cloud over this issue, the better, and so we do want it handled in an expeditious fashion.”

Pursuant to the budget amendment language that the General Assembly adopted on April 7, 2021, Nixon Peabody LLP has been appointed “to conduct an independent, third-party investigation of the Office of the State Inspector General’s policies, process, and procedures employed during its investigation of the Virginia Parole Board’s handling of the Vincent Martin matter.”
The OAG “both received solicitations and contacted firms with experiences in the arena of internal investigations…[and] in an effort to further ensure objectivity, the Office avoided contacting firms with strong Virginia-based connections. Recommendations were also solicited from the Office of the Governor, the Speaker of the House of Delegates, and the President pro tempore of the Senate. Seven of the eight qualifying firms expressed initial interest. Of those seven, four provided materials seeking appointment to this matter. Following consultation with the Office of the Governor, the Speaker of the House of Delegates, and the President pro tempore of the Senate, the Office has selected Nixon Peabody LLP.”
