Judge Sides with Virginia Democrats, Rules Youngkin’s Appointees Cannot Serve on Public College Boards

FAIRFAX, V.A. — Today, a Fairfax Circuit Court judge issued a preliminary injunction halting Governor Glenn Youngkin’s appointees from continuing to serve on the Board of Visitors at the University of Virginia, the Virginia Military Institute (VMI), and George Mason University.

The court ruling temporarily bars the appointees from taking any further action until the Virginia General Assembly confirms them- as required by the law. Attorney General Jason Miyares indicated in court last Friday that he plans to appeal this decision by Wednesday morning.

Senate Democratic Leaders issued the following statements in response:

Senator Aaron Rouse, Chair of the Senate Privileges and Elections Committee said, “As Chair of the Senate Privileges and Elections Committee, I take my responsibilities very seriously. Especially when it comes to protecting the integrity of our institutions and safeguarding our universities from partisan overreach. Today, the court affirmed what we have maintained all along. The Senate of Virginia has the constitutional authority to confirm or reject board nominees, and that authority cannot be bypassed. The ruling is a victory for the rule of law and the people of Virginia. We will use every tool available to fight back against the attacks on our university system. We will continue to stand up for transparency, accountability, and the democratic process for Virginia, students, educators, and families.”

“I’ve spent several years working in higher education, as a professor and administrator”, said Senator Mamie E. Locke, Chair of the Senate High Education Subcommittee. She continues, “This decision is a win for democracy in the Commonwealth. Governor Youngkin’s attempt to hijack our public universities for political gain is not just unacceptable, it’s unconstitutional. Virginia’s colleges and universities do not belong to Glenn Youngkin. They do not belong to Donald Trump. They do not belong to their extremist allies. They belong to the people of this Commonwealth, and we’re grateful the court affirmed that today.”

Senator L. Louise Lucas, Senate President Pro Tempore said “The Trump-Youngkin administration launched another blatant partisan power grab, this time targeting some of the top universities in the country, right here in Virginia. Once again, they tried to break the law in their attempt to force our progressive university leaders to bow to their will but, today they failed. The Code of Virginia makes it crystal clear that appointees to Virginia’s public colleges and universities are under the constitutional authority of the General Assembly. Therefore, we are prepared to fight them every step of the way because the stakes are too high for students across the Commonwealth. This isn’t just about who sits on a board. It’s about whether the future of Virginia’s colleges and universities will be guided by educators and experts, or hijacked by Trump, Youngkin, and their MAGA allies.”

VIRGINIA BEACH — Today, Senator Aaron Rouse released the following statement on Judge Jonathan Frieden’s decision upholding the Senate’s authority over university boards:

“As Chair of the Senate Privileges and Elections Committee, I take my responsibilities very seriously, especially when it comes to protecting the integrity of our institutions and safeguarding our universities from partisan overreach.

Today, the court affirmed what we have maintained all along: that the Virginia Senate has the constitutional authority to confirm or reject Board nominees, and that authority cannot be bypassed. The court found that the eight contested nominees were indeed rejected by the General Assembly and, as such, cannot continue to serve.

This ruling is a victory for the rule of law, for the Senate’s constitutional role, and for the people of Virginia. It also sends a clear message that attempts to impose political control over our public universities, whether from Richmond or Washington, will not go unchecked.

Hashmi Statement on Court Ruling that Youngkin’s Appointees Cannot Serve on Public College Boards if Not Confirmed by the Virginia Senate Committee

Richmond — Today, Virginia Senator Ghazala Hashmi (D-SD15), Chair of the Senate Education and Health Committee and Democratic nominee for Virginia Lieutenant Governor, released the following statement on the Fairfax Circuit Court’s issuance of a preliminary injunction halting Governor Glenn Youngkin’s appointees from continuing to serve on the Board of Visitors at the University of Virginia, the Virginia Military Institute (VMI), and George Mason University:

“Today’s ruling by the Fairfax Circuit Court is a critical affirmation of transparency, accountability, and the democratic principles that guide our public institutions. As a former college professor, I strongly support the court’s decision, which reinforces the duty of Virginia’s university boards to operate with integrity and within the bounds of the law.

“As Chair of the Senate Education and Health Committee, I have long championed the public’s right to be informed and involved in decisions impacting our education system. Virginia NAACP Supports Judicial Ruling Upholding Constitutional Integrity Against Political Overreach

 

 Richmond, Virginia –The NAACP Virginia State Conference stands firmly in support of the recent ruling by Fairfax County Circuit Court Judge Jonathan Frieden, which upholds the clear constitutional framework regarding gubernatorial appointees.

Virginia NAACP President Rev. Cozy Bailey issued the following statement:

“The integrity of our college institutions must be maintained, and every voice must be respected. It is unfortunate that Governor Youngkin and Attorney General Miyares have chosen to disregard these established rules, instead opting to pursue their own agenda. Furthermore, the decision by Attorney General Miyares to challenge this ruling in the Supreme Court represents a misallocation of taxpayer dollars and undermines the democratic process. This ruling is a victory for the rule of law and for the rights of the people of Virginia.”

The NAACP Virginia State Conference will continue its advocacy to protect the rights of all Virginians.

This mornning, another Democrat – “retired Marine Corps Lieutenant Colonel Michael Williamson – has announced that he’s throwing his hat in the ring for the nomination to take on the odious Rep. Jen Kiggans (R) in VA02 (a “purple” district that’s one of the DCCC’s top targets for 2026). In his announcement, Williamson rips into Kiggans (for good reason and 100% accurately!) as having “lied to us”; having “repeatedly voted against veterans”; and having supported Trump’s “dangerous policies like cutting Medicaid and food assistance for working families — all to fund more tax breaks for millionaires and billionaires.” Williamson pledges, in contrast, to “focus on expanding economic opportunity, defending constitutional checks and balances, protecting veterans’ care, lowering costs for families, and ensuring reproductive freedom.”

P.S. Other Democrats running for this nomination so far are James Osyf, John Burk Stringfellow and Nicolaus Sleister. May the best/strongest candidate win!

Marine Corps Veteran LtCol Michael Williamson Launches Campaign for Congress in Virginia’s 2nd District

Suffolk, VA — Today, retired Marine Corps Lieutenant Colonel Michael Williamson announced his campaign to represent Virginia’s 2nd Congressional District, pledging to restore accountability in Washington and deliver real leadership for Hampton Roads.

  • “I think the reason this is happening is because some of the MAGA universe who said that we were creating a deep state as Democrats are starting to realize that Trump is actually the one creating a deep state. He’s actually the one that’s kind of a phony, right? He was campaigning on the whole idea that there was a coverup, but now he’s the one covering up. And I think now they’re even coaching Ghislaine Maxwell, his lawyers are, on trying to make sure she says the right thing so she could possibly get a pardon. And so this is clearly a cover up. And honestly, I think this has become more of an interest to me even personally because at first I said, ‘Okay, this is the Epstein conspiracy.’ But the way the president has reacted to this shows that there is something seriously in there, something seriously going on here. There must have been more strong connection than we even think because of the way he’s acting and the way he’s reacting to this.”
  • I think he probably will [pardon Maxwell]. I mean, he pardoned the January 6th insurrectionists. He’s pardoned corrupt politicians. I mean, this is another square in his bingo card of terrible people he’s pardoned over the years.”
  • “Well, of course [House Republican leadership is] going to slow walk this. And they’re also going to make sure that whoever does come to that testimony and whoever does testify will be saying exactly what Donald Trump wants them to say. So, you know, James Comer and the Republicans are still loyal foot soldiers to Donald Trump, right? They’re doing his bidding. I think they’re feeling pressure at home to start speaking up or doing something about this, because their constituents are angry at them for covering up something that was a campaign promise last year to release the files. And so again, this is really bad for the president because people are realizing that he’s kind of a phony. His own people.”
  • “I think it’s pretty simple though. If he releases the files, this all goes away, right? Or at least for in our minds, the transparency is finally there. So why not? Why not release the files? Why not release the book? Why not just, you know, show everyone if you have nothing to hide, then just show us all the proof.”
  •   “…the reality is that we had a lot more business to do and [House Republicans have] been shirking that. And they’re the ones talking about Ghislaine Maxwell and Epstein, too. It’s not like we’re the only ones talking about it. And why is it important? Why is Epstein important? It’s not just about the files. It’s the fact that Ghislaine Maxwell and Jeffrey Epstein were running this terrible ring where they were exploiting these young women…and now Ghislaine Maxwell is trying to act like a victim. She is no victim. So, let’s remember that, too, when we’re talking about this issue.”
  • [“What do you make of the the the president’s personal attorney who is now the number two at the Justice Department, going down to Tallahassee for two days by himself to meet with Ghislaine Maxwell?”]”Yeah, he’s a fixer, right? He’s going down there to to make a deal with Ghislaine Maxwell. Ghislaine Maxwell is a documented liar. A lot of the charges on her are perjury… I’m still going to question her if I have the chance, but I don’t expect her to be truthful in those answers…she’ll just commit more perjury….What’s interesting is they are hanging this pardon over her head and in return for trying to get her to say whatever Trump wants her to say, right? So, let’s remember that when we do hear from her, but in the meantime, let’s remember what she is. She is a sex trafficker. She is a bad person and she is a criminal. And so, they need to make sure that she’s not seen as a victim.”

New State Navigate Forecast for 2025 Virginia Elections: “Democrats are heavily favored to win every level of the state government in Virginia this year.”

With just 99 days until the 2025 Virginia elections – for Governor, LG, AG and all 100 seats in the House of Delegates – I just got the following press release (see below) from the folks at State Navigate (Chaz Nuttycombe et al). The bottom line is good news for Virginia Democrats – although, as always, let’s take nothing for granted, “run through the tape,” etc.

Also, see below (or click on the links) for State Navigate’s maps for Governor, Lt. Governor, Attorney General and  House of Delegates. In short, Dems right now have a 96% chance of winning the governor’s race (most likely by about 11 points), an 89% chance of winning the LG race (most likely by about 8 points), a 90% chance of winning the AG race (most likely by about 8 points), and a 91% chance of winning the House of Delegates (most likely with 58 seats out of 100). So, again, let’s not take anything for granted, but this is encouraging. And remember, if we can do this, it will send a clear and loud message nationally about what we think about the horrrendous damage Trump, DOGE, etc. are doing to our Commonwealth and to our country.

 

We’re now less than 100 days from the November election this year, and State Navigate has released its first-ever forecasts just in the nick of time.

The State Navigate team has put together forecasts for the Virginia House of Delegates, and the statewide races in Virginia including GovernorLieutenant Governor, and Attorney General.

Democrats are heavily favored to win every level of the state government in Virginia this year. For control of the majority in the House of Delegates and each of the statewide races, there’s at least an 89% chance that Democrats win each, depending on the forecast.

    • A histogram of the likelihood of each seat makeup of the House of Delegates
    • Identifying the likelihood that each seat will decide a majority or supermajority
    • The odds of whether there will be a Democratic supermajority, majority, tie, or Republican majority in the chamber throughout the election

Here’s what features are available in the statewide forecasts:

    • Overall projections by margin and chances of victory in each race

VIRGINIA – Today Virginia Democrats launched three billboards along I-64 highlighting Winsome Earle-Sears praising the Trump tax bill that’s taking healthcare away from 322,000 Virginians and will force at least six rural hospitals to close. The billboards read “Trump’s Tax Bill: Takes healthcare away from 322,000+ Virginians. Trump’s tax bill ‘does so many great things.’ – Winsome Earle-Sears.”

“As 322,000 Virginians are being stripped of their healthcare and rural hospitals will be forced to close, Winsome Earle-Sears believes the Trump tax bill is doing ‘great things.’
Every time Virginians see these billboards, they’ll be reminded that Sears thinks Virginians losing access to healthcare is ‘great’ and she owes them answers about why she isn’t fighting for the Commonwealth,” said DPVA Spokesperson Maggie Amjad.

  • “What my colleague from Louisiana said is not consistent with what I’m actually seeing and hearing on the ground here in Virginia – not just in my district, but across the entire Commonwealth. Let’s start with education. School starts in three weeks here and our schools have been waiting for that grant money to help fill in gaps so they can be prepared for the students to come in and they’re worried. I’ve spoken to my local and state officials. They cannot fill the gaps left by the Department of Education if it is dismantled or defunded. They’re already struggling with the workforce cuts as particularly around dealing with students with disabilities and making sure they have the resources that they need to learn. That’s why the department was created…to fill in these gaps on the tariffs. My farmers are scared. My farmers, most of them here are small and family-owned farms, they have seen their costs rise, they are worried about the ability to export, particularly soy and corn, to other countries, as when the last time there was a trade war, Brazil began to eat into their their exports. So they’re worried and they’re strapped and they’re waiting for a farm bill that Congress has not even begun to address. And so what I’m hearing on the ground from my small business owners, whether it’s the bridal shop owner who has seen dresses go up 20% in some cases, they’re all feeling the pain now. They’re feeling the anxiety around lack of certainty now. And they’re being pinched now. They’re seeing their costs continue to rise and the president hasn’t done anything about that. And with the big ugly bill that just passed, health care costs, energy costs are all about to go up, while we are seeing energy jobs go away as the president and congressional Republicans kneecap the cleanest, fastest, and cheapest energy that we can get on the grid to meet demand.”
  • “We need certainty quickly. We need the these tariff wars to end. But part of our issue here in Virginia is not just about the tariffs and the trade policy. We have the second-highest number of federal employees. And Virginia is the only state where our unemployment rose in June. That is directly because of the federal workforce cuts and that is impacting our state economy…and again the bill that passed, the big ugly bill and the changes to Medicaid, are blowing a hole in our state budget that our state and local governments are worried that they’re going to either have to raise taxes on their own or significantly cut services. And our General Assembly is talking about a special session to deal with that in September.  And so there’s a lot of anxiety and pain here in Virginia all across the state, in Democratic and Republican areas. And that’s why we see the president’s approval rating across the board tanking, particularly on issues that he thinks he’s strong on, like the economy and immigration.”
  • “So, two points that are really important to make. State and local governments are not required by law to enforce immigration laws. That’s the federal government’s job. State and local governments have a lot on their plate already. But what we are seeing here in Virginia, here in my district from these crackdowns with ICE raiding courthouses and public spaces, it is starting to impact public safety. My prosecutors, my sheriffs, and my police chiefs have seen a precipitous drop in calls to 911, particularly in immigrant communities, particularly in domestic violence cases. People are not willing to report crimes. They’re not willing to cooperate with police. They’re not willing to be witnesses and testify in any cases. And my law enforcement is starting to see that and is worried that the trust that they had built across communities with citizens and non-citizens all across the region has broken down and it is impacting public safety.”
  • “…I think all Democrats should be in front of young people right now because they’re not just our future, they’re the present of the party and our government. And if you look at from our founding, every critical moment in American history, particularly when we have made progress towards making the ideals upon which this country was founded true for everybody, young people have been at the forefront. And as John Lewis said, who we just commemorated the fifth anniversary of his passing, democracy is not a state, it is an act that requires every generation to do its part to build the beloved community. And so we need all young people to have a seat at the table and to be engaged. And every Democrat, no matter where they are on the spectrum, no matter who they are, should be speaking to Gen Z as well as every generation to do our part to build a stronger America.”
  • “...a big reason why we see these [low poll] numbers [for Democrats] is because Democrats have not done as good a job in the past few years of reaching every voter in every community where they are, how they receive their information. And we’re beginning to do that. And I think it’s important that first we listen and we talk with voters about the issues that they care about and that we present solutions on how we’re going to address those issues. And we are doing that. And so, you know, we’ve got a lot of work to do to rebuild that trust, but it all starts with reaching out into every community, leaving no one behind and bringing them along with us to build a better America.”
