From Wild Virginia, see below for “a motion filed by conservation groups in the Court of Appeals for the Fourth Circuit requesting a stay of the U.S. Fish and Wildlife Service’s (FWS) biological opinion and incidental take statement for the Mountain Valley Pipeline (MVP). Plaintiffs previously requested an administrative stay from the FWS, which was denied on November 2, 2020.” Wild Virginia adds:
“The record shows that the Fish and Wildlife Service has again cut corners, ignored or weakened technical standards, and excluded pertinent facts without justification in approving of damages to endangered fish species and bats. The Service had more than a year to get these decisions right but have again fallen short of the high standards the American people have a right to expect, when it comes to protecting some of our rarest and most sensitive species.”
