Virginia AG Jason Miyares Joins Amicus Brief Arguing, Essentially, That America Shouldn’t Follow Rule of Law or the Constitution, and That the President Can Act as a Dictator

"The fact that Va’s attorney general backs this unconstitutional practice is utterly disgraceful."

So, what Jason Miyares et al are arguing (see below for screenshots of their amicus brief to the US Court of Appeals for the District of Columbia Circuit) is that, indeed, the President DOES have the authority to round up and deport anyone he wants, even completely innocent people, without due process or appeal, and deport them to a notorious prison in El Salvador where they can, as Jon Favreau points out (also, see below), “be tortured in a foreign gulag because they lit cars on fire” or for literally ANY REASON the president cites.

That, of course, goes against (as Jon Favreau explains very well): 1) the 14th amendment; 2) the 6th amendment; 3) the 4th amendment; 4) the 8th amendment; and probably a bunch of other provisions in the Constitution, the law, etc. But again, Jason Miyares and his fellow far-right Attorneys General DO NOT CARE.  Disgusting – and yet another example of why it’s IMPERATIVE that Virginia replace Miyares this November!

P.S. Following the rule of law and the constitution does NOT mean it’s ok to break the law – quite the contrary – but why even bother having rule of law or a constitution if you can just ignore it/violate it whenever you feel like it?  That would be what’s known as, yep, a *dictatorship*, which apparently Miyares et al are fine with. Also, not that right wingers are ever going to care, but the fact remains that immigrants commit crimes at a significantly LOWER rate than native-born Americans. And yes, facts are stubborn things…

P.P.S. As Arlington Commonwealth’s Attorney Parisa Dehghani-Tafti puts it: The administration violates the bare minimum tenets of due process by disappearing people into forced labor prison camps. The fact that Va’s attorney general backs this unconstitutional practice is utterly disgraceful.”
