Washington, D.C. — Today, New Democrat Coalition Trade & Tariffs Task Force Chair Don Beyer (VA-08) issued a statement after the Supreme Court ruled that the President violated federal law by illegally exceeding his authority under the International Emergency Economic Powers Act (IEEPA) to impose sweeping tariffs. Chair Beyer previously called on the Supreme Court to limit the President’s use of emergency powers following oral arguments in this case last November.
“For nearly a year, President Trump has raised prices for the American people, depressed job growth and put our economic wellbeing at risk. He has repeatedly disregarded the Constitution to unilaterally impose sweeping tariffs without credible reason or cause, crushing American consumers and small businesses under these new taxes to help pay for giveaways to his wealthy friends. Now, at last, the Supreme Court has ruled that he broke the law to do so.
“Even Trump’s Supreme Court allies, who have bent over backwards to give him unprecedented powers over and over again, had to admit that his tariffs are unconstitutional and illegal.
“While this is a win for the American people and American businesses who will no longer have to pay these taxes, much of the damage is done. Manufacturers closed their doors and let go of workers as their costs skyrocketed. Small businesses have shuttered, and those that survived will have a hard time claiming the money they are owed under this framework, while consumers who have paid more for everyday necessities will likely never receive a refund.
“These brutal losses could have been avoided if Congressional Republicans had the courage to stand up to Trump and end his trade war sooner. The American people will remember who fought for affordability and who called it a hoax.”

KAINE WELCOMES SUPREME COURT RULING AGAINST TRUMP’S ABUSE OF TARIFF POWERS
WASHINGTON, D.C. – Today, U.S. Senator Tim Kaine (D-VA), a member of the Senate Budget Committee and former civil rights attorney, praised the Supreme Court’s ruling in Learning Resources v. Trump and Trump v. V.O.S. Selections, Inc. that the Trump Administration abused its authorities under emergency economic power legislation to impose broad-based tariffs. Kaine joined an amicus brief in the cases against Trump and has led four successful Senate bills to nullify Trump’s broad-based tariffs.
“President Trump’s effort to use emergency powers to impose broad-based tariffs on key allies and trading partners was unlawful and ill-advised from the start, and I am glad that the Supreme Court ruled against this egregious and destructive abuse of presidential power,” said Kaine. “Broad-based tariffs are a tax on American consumers, and the Trump Administration’s attempt to pretend otherwise was laughable in its inaccuracy and deeply disrespectful to the millions of American consumers who have faced higher prices because of Trump’s unaffordable economic policies. The Supreme Court did its job here in upholding the bedrock principle of separation of powers – Congress must step up and do the same on tariffs, war powers, and many other issues.”
Kaine has been a leading voice in the U.S. Senate on challenging President Donald Trump’s abuse of emergency powers, especially related to tariffs, and on reasserting Congress’ role as a coequal branch of government. Kaine has led four successful bipartisan pieces of legislation – one in April 2025 and three in October 2025 – to passage in the Senate to nullify Trump’s broad-based tariffs, including a global tariff and levies on Canada and Brazil. Kaine has also forced two votes on his legislation to end Trump’s spurious energy emergency declaration, which the Administration undertook as a backdoor method of circumventing clean-energy policies and enriching Big Oil donors. He has also fought against the Trump Administration’s abuse of executive power in foreign policy, including leading the successful passage of legislation to repeal the 1991 and 2002 Authorizations for Use of Military Force (AUMFs) and introducing War Powers Resolutions for Venezuela, the Caribbean, and Iran.

~ On the Supreme Court striking down Trump’s illegal tariffs ~
WASHINGTON – U.S. Sen. Mark R. Warner (D-VA), a member of the Senate Finance Committee, issued the following statement on the U.S. Supreme Court voting 6-3 to strike down President Trump’s sweeping tariffs imposed on products Americans buy from other countries:
“Today’s ruling is a win for American families who have been paying the price for Donald Trump’s reckless tariff agenda. Let’s be clear: tariffs are a tax on American consumers and small businesses already struggling to keep up with rising costs. As families struggle to afford groceries, rent, and everyday essentials, President Trump doubled down on a blanket tariff policy that drove up prices across the board and injected unnecessary chaos into our economy. His whiplash approach has also undermined trust with our allies and opened the door for China to present itself as a more reliable trading partner than the United States.
“We need a smarter, targeted approach to trade that actually strengthens American competitiveness and helps workers without punishing the very people it’s supposed to help – and one that respects Congress’s role in setting trade policy. Today’s decision is an important step toward restoring some economic sanity for hardworking Americans.”
Sen. Warner has been a consistent voice in Congress pushing back on President Donald Trump’s tariff policies, which he has criticized as a tax on American families and small businesses. Warner has joined Sen. Tim Kaine (D-VA) and other colleagues in advancing bipartisan legislation to repeal the administration’s tariffs on Canada imposed under the International Emergency Economic Powers Act. The measure passed the Senate with bipartisan support and a version of the bill was subsequently approved by the U.S. House of Representatives, reflecting growing congressional opposition to tariff policies that have raised costs for consumers, strained relationships with key allies, and disrupted cross-border trade.

Rep. Luria Releases Statement on Trump’s Cost-Spiking Tariffs Which Jen Kiggans Has Voted to Support
VIRGINIA BEACH, Va. – Former small business owner, 20-year U.S. Navy veteran, and two-term member of Congress Rep. Elaine Luria released the following statement on Trump’s cost-spiking tariffs that Congresswoman Jen Kiggans has repeatedly voted to keep in place, despite the fact that they have cost the average American household $1,700 more:
“Jen Kiggans campaigned on a phony promise to lower costs for Coastal Virginians, but she has repeatedly voted to protect Trump’s cost-spiking tariffs which have made everything from groceries to housing more expensive. Just days ago, Kiggans voted to protect the very tariffs that were struck down by the Supreme Court today, keeping costs high for Hampton Roads and putting her own interests first – even while other members of her party chose to do the right thing. Tariffs are a tax on working families–slowing our economy and causing prices to skyrocket. When I get to Congress I will do what Kiggans hasn’t: fight back against reckless tariffs and work to make life more affordable.”
Kiggans has a clear, established record of voting for higher prices. In February, she once again voted to protect Trump’s reckless tariffs despite members of her own party breaking with the President. She also previously voted to protect the tariffs in March of 2025 and again in September of 2025. In January, Jen Kiggans voted against extending the Affordable Care Act (ACA) tax credits as Virginians face skyrocketing health care costs because of her inaction. Jen Kiggans refused to sign a bipartisan measure in December backed by a majority of members of Congress that would extend the ACA tax credits.
Kiggans has established a pattern of promising Virginians one thing in public, only to turn around and vote the other way in Washington. Kiggans lied when she promised to protect access to health care, only to turn around and vote for the largest cuts to Medicaid in history. Kiggans lied again when she promised to protect clean energy tax credits, but then “flip-flopped” and voted to take a “sledgehammer” to the credits instead. Kiggans has voted 100% of the time with Donald Trump – demonstrating that she puts her D.C. party bosses ahead of the Virginians she claims to represent.
