Sen. Chap Petersen Files Motion to Voluntarily Dismiss His Challenge to Virginia’s COVID-19 Safety Measures

See below for an update from AG Mark Herring’s office on this absurd case by State Sen. Chap Petersen (D-Fairfax), which (falsely) claimed that Gov. Northam’s COVID-19 Emergency Constitutes “a continuing violation of the United States and Virginia Constitutions.” As you can see, this case – and other, similar cases – have gone nowhere…and for good reason(s).

Senator Chap Petersen has just filed a motion to voluntarily dismiss his challenge to Virginia’s proven COVID safety measures.

Sen. Petersen originally filed a motion for preliminary injunction earlier this month seeking to nullify the Commonwealth’s COVID mitigation efforts, but Judge Gibney denied his request earlier this week.

Attorney General Herring and his team have continuously won cases in defense of Virginia’s COVID safety measures, including two successful defenses of the mask and face covering requirements. Attorney General Herring is committed to doing all he can to keep Virginians, their families, and their communities safe during these unprecedented times.
