This is exactly what you’d expect a bunch of right-wing-activist judges, three of whom were nominated by Donald Trump, to do. Of course, these are the same lawless Republicans-in-robes who also claimed that the president has “absolute immunity,” delayed and delayed to guarantee Trump wouldn’t face justice before the election, etc, etc.
BTW, if you want some background on why the Supreme Court majority got this wrong, see U.S. Court of Appeals for the Fourth Circuit Panel Rules Unanimously *Against* Youngkin’s, Miyares’ Attempts to Purge Voters Days Before Presidential Election, which found, “appellants argue the challenged conduct does not violate the National Voter Registration Act (NVRA). Like the district court, we are unpersuaded.” Also see Video: Executive Director for the Virginia Coalition for Immigrant Rights Says They’re Currently Awaiting – Hopefully – an “injunction…essentially stopping [Youngkin’s voter purge] Executive Order 35 for *this* election” (“Not only is Glenn Youngkin’s illegal voter purge being conducted too close to Election Day, it is also disproportionately targeting naturalized citizens who are lawfully registered to vote.”) and Virginia NAACP Responds to Gov. Youngkin’s Illegal Voter Purge Prog (“This case has proven what we already know to be true – Governor Youngkin and his political cronies think winning is more important than democracy.”).
“this is an absurd “shadow docket” ruling. The plain text of Section 8(c)(2) of the NVRA prohibits systematic purges of voter rolls w/in 90 days of the election. The purported textualists on the Court (all 6 GOP nominees) ignore that by granting a stay.”
“In a disgraceful departure from the so-called Purcell principle which SCOTUS uses to reject changes too close to elections, they will permit Virginia to continue to remove voters from the rolls. The liberal justices all dissent.”
One of the most knowledgeable Supreme Court/legal analysts out there, Ian Millhiser of Vox, nails it:
“The Supreme Court issued a surprising order on Wednesday morning that allows Virginia’s Republican governor to openly defy a federal voting rights law….Virginia’s legal arguments would effectively repeal the ban on voter purges close to an election”
