Enviro Groups File Petition with 4th Circuit Court of Appeals Challenging US Fish & Wildlife Service’s Biological Opinion, Incidental Take Statement for Mountain Valley Pipeline

Please find the attached Petition filed in the Court of Appeals for the Fourth Circuit, challenging the U.S. Fish and Wildlife Service’s biological opinion and incidental take statement for Mountain Valley Pipeline.

This follows plaintiffs’ request for a stay of these approvals filed with the federal agencies earlier today. We reiterate the statement from our previous email, below:

On its second attempt to perform its legally-mandated duties, the Fish and Wildlife Service has again failed to perform adequate scientific analyses, thereby threatening the health and survival of some of our rarest and most valued species.

…Our federal agencies, which are charged with protection of the public and our resources, have repeatedly failed us. Wild Virginia and our allies will continue to seek an end to MVP’s destruction and, in doing so, are forced to seek relief from the courts. This pipeline should never be completed and its future is far from certain.

I couldn’t agree more; it’s time to put an end to this brain-dead, fracked-gas, fossil-foolish, corporate boondoggle once and for all. Hopefully, a Biden administration – assuming we win the election next Tuesday and the Supreme Court doesn’t help Trump steal it – will do so once and for all, but for now…the fight continues!
