Del. Toscano on April 11 ABC Situation: “I…do not recall an incident like this”

STATEMENT FROM DELEGATE DAVID J. TOSCANO ON ABC CHAIRMAN’S CALL FOR STATE POLICE INVESTIGATION

CHARLOTTESVILLE – Delegate David J. Toscano released a statement today in response to ABC Board Chairman J. Neal Insley’s call for a Virginia State Police investigation of the April 11, 2013 incident in Charlottesville:

“Chairman Insley’s request for an impartial, third party review of the incident involving ABC law enforcement personnel is encouraging,” said Toscano. “A number of questions about this incident have been raised, and I believe this independent investigation by Virginia State Police will provide insight as to what went wrong, and how ABC can improve and implement better protocols and procedures to ensure that an incident like this does not occur again.”

Delegate Toscano recently sent a letter inquiring about the proper protocols and procedures to Shawn Walker, Director of Enforcement at ABC. In his letter, Mr. Toscano inquired about what policies are currently in place for ABC law enforcement to detain citizens when enforcement officers suspect individuals may be underage and in possession of alcohol, and specifically, what procedures are in place to detain individuals already in motor vehicles.  Additionally, Mr. Toscano inquired as to the specific training ABC law enforcement personnel receive in handling their weapons, and what protocols are in place to determine when an officer of ABC should unholster their weapon.

“I have lived in this community for over 30 years, and do not recall an incident like this during that time,” wrote Toscano. “I appreciate the role that ABC plays in enforcing the laws against underage purchase, possession, and consumption. But I am concerned about the apparent overreaction of the agents during the April 11 event.”

Equality Virginia Supports Actions Taken by the Virginia ACLU and Lambda Legal

The ACLU of Virginia announced today that it will be filing suit in federal court to challenge the constitutionality of Virginia’s laws denying same sex couples the freedom to marry or to obtain legal recognition of any kind for their unions. Lawyers from the ACLU of Virginia will be part of a team of lawyers from the national ACLU and Lambda Legal that will be arguing that the Virginia constitution and statutes denying the freedom to marry violate the federal constitutional guarantee of equal protection under the law.  

“Since the Supreme Court’s ground breaking ruling on the Defense of Marriage Act, it remains unclear what exactly the decision means for loving gay and lesbian couples in Virginia,” said Equality Virginia’s Executive Director, James Parrish. “We applaud and support the actions of the ACLU and Lambda Legal to help bring all of the benefits, rights, and responsibilities that come with marriage equality to every family in Virginia.”

As part of our mission of changing hearts and minds, Equality Virginia is working with the ACLU of Virginia and Lambda Legal to identify Virginia couples and families who are willing to share their stories publicly as part of the freedom to marry initiative. The ACLU of Virginia and Lambda Legal say "that they will file suit against Virginia's gay marriage ban, arguing that it violates the Constitutional guarantee of equal protection under the law." (WJLA

This is the kind of action we've been waiting for, and we can't wait another minute to show our support!

The ACLU and Lambda Legal are taking on the Commonwealth to bring federal marriage benefits to same-sex couples (Washington Times).  That won't be easy with people like Cuccinelli in the Attorney General's office.

The Spirit that Drove Us to Civil War Is Back

In our times, a destructive force has emerged in the American political system. This force — or spirit – should be understood as the re-emergence onto center stage of what drove the United States to polarize, break apart, and fight a bloody Civil War a century and a half ago.

This destructive force is damaging our nation now just as it did then.

The persistence through time of a recognizable pattern in a culture points to an important part of how the human world works.  Just as Great-grandpa’s red hair reappears in a new baby, so also can the patterns of social and political dynamics (in this case, destructive dynamics) move through the generations within a society. Such a pattern, or spirit, can perpetuate itself by socializing individuals in ways that lead them, in turn, to reinforce in the world around them the patterns that had been impressed upon them.

The parallels between the political crisis in America in our times, and the crisis that drove America into a terrible Civil War a century and a half ago, reveal how a spirit of this sort has re-emerged to hold major parts of the American cultural system in its grip and animate the actions, beliefs, and attitudes of millions.

I begin here a series of articles to delineate these telling parallels.  Perceiving the same pattern in these two important eras — our present crisis, and the crisis that led to the Civil War — can be revelatory just like the images in the Magic Eye books: out of the stereoscopic image, a startling figure emerges with depth out of a new dimension.

The play of forces in our society, admittedly, is far more complex than to allow one crisis to be simply a replay of a crisis of a century and a half ago. Each time has its own set of circumstances and its own mixtures and alignments of forces.

Nonetheless, the parallels between the growing crisis of 1848-1861 and that of, say, 1994 to the present- are significant.  In each case, one finds:

• Insistence on pressing conflict over seeking accord

• Systematic overreaching

• A warped view of reality, driven by bogus and invalid ideas

• A drive toward exploitation masked by deception and self-deception

• Use of divisive tactics to manipulate supporters

These and other parallels will be explored in this series to reveal the dark spirit at work in both eras. In the next posting, some remarks by Abraham Lincoln will help provide a glimpse into one such manifestation of that spirit.

New DPVA Video: Cuccinelli’s Empty Rhetoric on Star Scandal Hurts VA

The Democratic Party of Virginia today released a new web video contrasting Ken Cuccinelli’s efforts to duck and dodge his own ethics scandal with media coverage detailing how deeply he is involved with the Star Scientific scandal and the related Governor’s Mansion Chef case. The new video is available here.

As the scandal involving his conflict of interest with Star Scientific and its CEO Jonnie Williams continues to drive statewide coverage, Cuccinelli is desperately trying to convince Virginians he is not a part of this growing mess. Unfortunately for him, the gap between the Attorney General’s rhetoric and reality continues to widen as more and more questions emerge about his actions in the two cases involving Williams from which he eventually recused himself.  

When questioned about his involvement in the case involving former Executive Mansion Chef Todd Schneider on Monday – the same day a hearing was being held on whether the case should be thrown out because of Cuccinelli’s conflict of interest – Ken Cuccinelli actually said that he had “no involvement” in the issue, and that the case “isn’t related” to him. Cuccinelli’s statement was baffling at best, given the case, given Monday’s hearing, and given that he has received $18,000 in gifts from Williams and Star.

“Just hours before a judge heard arguments about whether his conflict of interest had so tainted the case against Todd Schneider that it would have to be dismissed, Ken Cuccinelli actually tried to pull the wool over the eyes of Virginians and claim that he had ‘no involvement’ in the scandalous proceeding,” said DPVA spokesman Brian Coy. “Rather than trying to duck accountability for his involvement in this growing scandal, Ken Cuccinelli should come clean and be honest with the Commonwealth about whether Jonnie Williams’ financial patronage influenced the Attorney General’s handling of the chef’s case. It’s time Cuccinelli gives Virginians some real answers, not more tall tales.”

McDonnell Accepts Plea Deal: Bearing Drift Editor to Resign

Not since Agnew and Nixon have Republicans been fighting among themselves to see who can resign first. It now appears the bombshell resignation story posted this past weekend on the conservative blog Bearing Drift – “What goes around comes around: Bob McDonnell to resign as part of plea agreement” – was right after all about there being a resignation deal involving the Governor. However, the controversial poster Willie “Tell Them Willie Boy is Here” Deutsch appears to have mixed up the elements to his story, creating an internet bombshell that has been dropped on his own conservative journalistic troops.

According to multiple sources, Bearing Drift editor-in-chief Shaun Kenney, in hopes of saving what is left of his reputation and that of his blog, is in the process of cutting a plea deal with McDonnell’s lawyers, along with the Governor’s appointee as Internet Censor in Chief, UVA Professor Larry Sabato (aka Cato The Elder). The provisions in the plea deal will apparently require Mr. Kenney to resign his position, return all the gifts given to him by those seeking to influence the positions taken by his blog, and a promise by the now defrocked high priest of iconoclastic conservatism to refrain from posting or in any way publishing future pieces on Virginia politics unless Sabato The Elder first determines such writings are free of any irresponsible rumor mongering.

As for Willie “Tell Them Willie Boy is Here” Deutsch, he remains defiant, accusing the blog of being the political equivalent of the Diary of a Wimpy Kid, not a steadfast defender of the conservative truth.    

I admit: These stunning revelations, one on top of another, are food for thought, as is the “meatball” controversy between Governor McDonnell’s lawyer Tony Troy and His Excellency’s press guy Tucker Martin. Early yesterday, Mr. Troy said that the Governor’s kids had not wrongfully taken any food from the Mansion and his client didn’t need to reimburse any money. Mr. Troy compared the situation to when his mom gave him a cold meatball sandwich for the drive back to college.

Good mom, good story: but a little dated apparently since shortly thereafter. Mr. Martin later revealed that the Governor McDonnell sent a $2,400 check to the state to cover whatever food his kids might have wrongfully taken from the Mansion. Mr. Troy had said the kid’s expenses amounted to maybe 50 bucks, give or take, for each college return. The press guy said his boss was only making reimbursement to silence the liberals and other political enemies of the Governor determined to make a political meal out of this non-story.

Foodgate, Resignationgate, Giftgate, Rolexgate, Weddinggate, Shoppingspreegate, Starscientificstockgate, Chefgate, Bearingdriftgate. I ask you: What is a Virginian to believe or not believe about the Governor, bloggers, censors, you name it? No wonder people yearn for a simpler time, when you had the Soviet Union on one side, the US of A on the other, with 30,000 nuclear missiles pointed at each other and Dr. Strangelove plotting first-strike strategies. The world back then was protected by a workable MAD strategy, Mutually Assured Destruction.

But that was back then. So where are we right now?

Willie “Tell Them Willie Boy is Here” Deutsch may have just had his fifteen minutes of fame, as the adage goes. Mr. Shaun Kenney’s reputation is now directly tied to Willie Boy. They will be forever known as the Dumb and Dumber of political journalism unless the Governor suffers the fate claimed on Bearing Drift. The blog’s reputation is likewise directly tied to their fate.

As for the Governor, it is hard to believe he has screwed up to the point of having to resign: but it is becoming easy to believe that he screwed up to the point of being resigned to the fact his political career might be over, both in Virginia and nationally.

So in that sense, Governor McDonnell resigned several months ago. But people are only now beginning to notice.

Video: Cuccinelli Says League of Women Voters/AARP Debate a “left wing, stacked” Forum!!!

So…Ken Cuccinelli is nuts AND corrupt AND extreme AND a coward. Check this out:

Ken Cuccinelli Monday dismissed a proposed AARP Virginia and League of Women Voters gubernatorial debate as a “left wing, stacked” affair, one week after he missed a deadline to sign on as a participant in the forum.

Responding to a reporter’s question about why he declined the invitation, the attorney general and Republican nominee for governor offered that assessment while campaigning in Norfolk.

“Oh, the left wing, stacked debate,” Cuccinelli said. “Well, you’ve got MSNBC as the proposed folks running it.”

That debate had been tentatively scheduled for Oct. 14.

It was to be moderated by CBS This Morning host Norah O’Donnell, a former MSNBC host, and  broadcast by Richmond area CBS affiliate and a local public television station, with the option for other broadcasters to pick up the feed.

The jointly-sponsored event has been a traditional debate during statewide races in Virginia: Tim Kaine and George Allen participated last year, while Bob McDonnell and Creigh Deeds faced-off in that forum four years ago.

So, this debate – which is NOT run by MSNBC, nor are AARP and the League of Women Voters “left wing” – was good enough for George Allen and Bob McDonnell, but not for Ken Cuccinelli? That really says it all about Cooch, huh?

P.S. You’ve also gotta love Cuccinelli’s claim that the Hampton Roads Chamber of Commerce is somehow neutral. In fact, according to VPAP, the Hampton Roads Chamber of Commerce has given 65% of its donations to Republicans, 24% to “Other,” and a miniscule 9% to Democrats since 2001. That includes $5,000 to Gov. Bob McDonnell (R), $2,250 to House Speaker Bill Howell (R-ALEC), etc. But this organization is fair and balanced in Cuccinelli’s (warped) mind? Of course, he also probably thinks Faux “News” (aka, 24/7 GOP Propaganda Channel) is really “fair and balanced.”  Heh.

P.P.S. According to VPAP, the AARP has given 52% to Virginia Republicans, 48% to Virginia Democrats.  

Cuccinelli Referenced 44 Times in 14 Pages in Case He Claims “Isn’t Related to Me”

Attorney General Ken Cuccinelli made an unbelievable claim this morning: the court case involving the former Executive Mansion Chef, he said, “isn’t related to me.”

This is the same case Cuccinelli’s myriad of conflicts forced him to recuse himself from under public pressure  – the same case his political campaign now claims he was “walled off” from for five months due to his relationship with Star Scientific CEO Jonnie Williams. In a recent filing on the case, Cuccinelli and his office are referenced at least 44 times in only 14 pages. Today, this case may be dismissed because of Cuccinelli’s conflicts.

“It is a good thing Ken Cuccinelli wasn’t under oath when he misled Virginia voters about his extensive involvement in this ongoing court case,” said Josh Schwerin, McAuliffe for Governor spokesman. “Cuccinelli’s credibility has been permanently damaged by his repeated false statements about his involvement with Jonnie Williams and the Star Scientific scandal.”

“Cuccinelli claimed he reported all gifts from Williams and Star Scientific, which was false. He claimed he had no conflict in the court case, which he later admitted was inaccurate. Now Cuccinelli is claiming the case ‘isn’t related to’ him – another false statement he will likely later own up to being inaccurate. Where do the false statements and misinformation end?” said Schwerin.

My Two Cents: Bill to End the Independence of the SEC and other Crucial Panels Is Just Plain Wrong

I have sat on this post for several days. But this information must be shared, no matter how uncomfortable it makes us. We learned in 2007-8 what lax oversight means to this country. If we hoped for any lasting future protections from predatory practices, they were dashed this past week with news of the following Editorial Board editorial from the New York Times. Here we learn that the independence of critical protections are at stake.


For all its rabid partisanship, Congress has shown time and again that it is willing to come together to deregulate corporate America. The latest example is a new bill in the Senate that would effectively end the independence of independent regulatory agencies, including the Securities and Exchange Commission, the Consumer Financial Protection Bureau, the Consumer Product Safety Commission and the National Labor Relations Board.

And you know the hijacked (by the Tea Party) House of Representatives will be eager to pass such predation should it pass the Senate. It is bad enough that Dodd-Frank under-protected us, but for Senators to try to weaken even that bill is inexcusable. Making the commissions and Bureaus less independent will do just that. And the SEC isn’t the only entity the senators have taken aim at. Strikingly, Virginians have one of their our own to “thank” for this: US Senator Mark Warner. He is joined by Rob Portman and Susan Collins.

So we have a Congress, which will not do anything helpful to the American people to save its life. But it works to eliminate what little protections Americans have. You know where this “train” is headed” and that is right over the cliff.

Just remember, Marion “Pat” Robertson has given $718,000 to Virginia Republicans over the years, including about $100,000 to our corrupt, grifter Governor Bob McDonnell. And note that none of these Republicans ever condemn this bigoted imbecile’s remarks or return his money. Fascinating, eh?
