We Need Our Politics to Be Reasonable

This article ran in the Northern Virginia Daily, one of the two main newspapers serving the 26th senatorial district, where I am running as the Democratic nominee to replace Mark Obenshain in the Virginia State Senate.

I know I’m not the only one unhappy with the state of our politics these days.  Here’s the change I’d like to see in how our politics are conducted.

Our founders were men of reason.  And they tried to set up a system of government in which the people would elect representatives who, reasoning together, would achieve the public good.

Wouldn’t it be nice if, in our General Assembly, our leaders would engage in reasoned discussion to find those policies that would lead to the best possible Virginia? Wouldn’t it be good if we citizens could discuss our public business in the same spirit?

Some recent criticism of me helps show the gulf between how we discuss issues these days and how the men of reason who founded our nation would have wanted us to discuss them.

This criticism took note of my saying we should act responsibly in the face of the challenge of climate change- took note of it, that is, to dismiss it as a “doomsday message.”

Nothing reasonable in such dismissal.

Reason tells us that on scientific questions, we should listen to the scientists. The question, “What’s happening to earth’s climate?” is a scientific question. And 97 percent of the scientists in the field of climate agree there’s a problem we urgently need to address.

When the best understanding that humankind has available to it is sending us such a clear warning, it is not a “doomsday message” to say we should heed that warning. It’s simply common sense.

In science, 97 percent agreement means the scientists are virtually unanimous. There is no conceivable justification for any politician – or any other layman, for that matter – to pretend to understand a scientific matter better than the scientists. Or to ignore the scientists either.

The insurance companies are following reason, making provision for the changes that are happening. The Pentagon is following reason, recognizing that climate change is a major concern for our national security.

It’s time that Virginia’s General Assembly act in accordance with reason – and do what it can to protect our children and grandchildren from a “doomsday” scenario.

It’s time our elected leaders stop doing the bidding of fossil fuel companies – companies that pour money into politicians’ coffers – that want to keep us addicted to what they’re selling.

(And now especially it is time, when clean energy – such as solar – is fast becoming our cheapest available source of energy.)

That same critic illustrated another unreasonable aspect of our political discourse concerned the Second Amendment.

“Where does Moore stand on the Second Amendment?” this critic asked, as if he expected to expose me as an enemy of liberty.

I’ve not taken a public position on gun rights, but I’m happy to do so now. I believe that the right of the people to bear arms should be respected just like the other rights enshrined in our Constitution, like the right to free speech.

We are fortunate that the Supreme Court has been quite vigilant in protecting our right to free speech. But I expect we’d all agree with what the famous Supreme Court justice, Oliver Wendell Holmes Jr., said – that the First Amendment did not mean that anyone had the right to shout “Fire!” in a crowded theater.

Likewise with freedom of religion. This is something we Americans hold especially dear – but we don’t allow human sacrifice.

Americans have understood that it is inevitable that important values will collide, and that wise ways of balancing them must be found. So we Americans have traditionally rejected making our important rights into absolutes and seek instead to draw the reasonable lines.

As with freedoms of speech and of religion, so also with gun rights. Gun rights should be protected, and we also should have reasoned discussions to decide where, in the realm of guns, there might be the equivalent of shouting “Fire!” in a crowded theater.

That’s why I wouldn’t want to get a 100 percent rating from the NRA: I’d rather align myself with the members of the NRA of whom an overwhelming majority (74 percent) favor the universal background checks that the NRA works to block.

Always we should be asking, “What will help us create the best possible Virginia?” We won’t get there by unreasonably ignoring the best available knowledge, and we won’t get there by crippling ourselves with unreasonable absolutes.

KAINE ANNOUNCES SUPPORT FOR IRAN NUCLEAR DEAL

WASHINGTON, D.C. – In remarks on the Senate floor today, U.S. Senator Tim Kaine, a member of the Senate Foreign Relations & Armed Services Committees and co-author of the Iran Nuclear Agreement Review Act, announced his support for the Joint Comprehensive Plan of Action (JCPOA) to peacefully limit Iran’s nuclear program.

In announcing his support, Kaine said: “I conclude that the JCPOA is a dramatic improvement over the status quo in improving global security. The agreement takes a nuclear weapons program that was on the verge of success and disables it for many years through peaceful diplomatic means with sufficient tools for the international community to verify whether Iran is meeting its commitments. In the negotiation, America has honored its best traditions and shown that patient diplomacy can achieve what isolation and hostility cannot.  For this reason, I will support it.”

 

Kaine’s full remarks are below:  

 

In November 2013, the United States and five global powers–the P5+1–announced an interim deal to freeze Iran’s nuclear program and negotiate a diplomatic resolution to one of the most important issues affecting global security.  Since then, as a member of the Senate Armed Services and Foreign Relations Committees, I have participated in scores of hearings, classified briefings, meetings and calls about this topic in Virginia, Washington and during five trips to the Middle East, including two trips to Israel.   I have listened to the Administration, to allied nations in the Middle East and elsewhere, to national security and foreign policy experts, to critics and proponents of the deal, to current and former Senate colleagues (especially former Armed Services Chairmen John Warner and Carl Levin), to American military leaders and  troops and to my constituents. I helped write the Iran Nuclear Agreement Review Act, under which Congress is currently engaging in a 60 day review period to approve or disapprove of the suspension of Congressional sanctions as part of the final deal announced on July 15.

 

Based on my review of this complex matter, I acknowledge that every option before us involves risk, with upside and downside consequences.  I understand how people of good will can reach different conclusions. But I also conclude that the Joint Comprehensive Plan of Action (JCPOA) is a dramatic improvement over the status quo in improving global security for at least 15 years and likely longer.  In this deal, America has honored its best traditions and shown that patient diplomacy can achieve what isolation and hostility cannot. For this reason, I will support it.

 

Prior to the interim agreement of November 2013, and even in the face of a punishing international sanctions regime, Iran’s nuclear program was marching ahead:

 

  • Iran had amassed more than 19,000 centrifuges to enrich uranium and that number was growing;
  • Iran had produced more than 11,000 kilograms of enriched uranium and that stockpile was growing;
  • Iran had perfected the ability to enrich uranium to the 20% level and that enrichment percentage was growing;
  • Iran was constructing a heavy water reactor at Arak capable of producing weapons grade plutonium;
  • Iran only allowed limited IAEA access to declared nuclear facilities, shielding its operation of covert nuclear sites.

 

The program was months away from being able to produce enough enriched uranium to make a nuclear weapon. As Israeli Prime Minister Benjamin Netanyahu told the United Nations in September 2012: “For over seven years, the international community has tried sanctions with Iran.   Under the leadership of President Obama, the international community has passed some of the strongest sanctions to date. … It’s had an effect on the economy, but we must face the truth. Sanctions have not stopped Iran’s nuclear program.”

 

We must face the truth. A punishing sanctions regime did not stop Iran’s nuclear program.  The nuclear program will only stop by a diplomatic agreement or by military action. While military action must be an option, it is in America’s interest—and the interest of the entire world—to use every effort to find a diplomatic resolution.  In fact, that was the purpose of Iranian sanctions from the very beginning, to open a path to a diplomatic solution.

 

We now have a diplomatic solution on the table.  The JCPOA is not perfect because all parties made concessions, as is the case in any serious diplomatic negotiation. But it has gained broad international support because it prevents Iran from getting sufficient uranium for a bomb for at least 15 years.   It also stops any pathway to a plutonium weapon for that period and exposes Iranian covert activity to enhanced scrutiny by the international community forever. Under the deal, Iran does the following:

 

  • It affirms that “under no circumstances will Iran ever seek, develop or acquire any nuclear weapons”;
  • It reduces its quantity of centrifuges by more than two thirds;
  • It slashes its uranium stockpile by 97%, to 300 kilograms, for 15 years.  This is dramatically less than what Iran would need to produce a single nuclear weapon;
  • It caps the enrichment level of the remaining uranium stockpile during that period at 3.67%;
  • It reconfigures the Arak heavy water reactor so that it can no longer produce weapons grade plutonium;
  • It commits to a series of limitations on research and development activities to guarantee that any nuclear program will be “for exclusively peaceful purposes” in full compliance with international non-proliferation rules;
  • It agrees to a robust set of international inspections of its declared nuclear facilities, its entire uranium supply chain and its suspected covert facilities by a team of 130+ IAEA inspectors.

 

After year 15, the unique caps and requirements imposed on Iran are progressively lifted through year 25.  After year 25, Iran is permanently obligated to abide by all international Non-Proliferation Treaty requirements, including the extensive inspections required by the NPT Additional Protocol.   And its agreement that it will never “seek, develop or acquire any nuclear weapons” continues forever.

 

If Iran breaks its agreement, nuclear sanctions can be reimposed.  The United States reserves the right to sanction Iran for activities unrelated to its nuclear program—including support for terrorism, arms shipments and human rights violations.  Finally, and importantly, the U.S. and its partners maintain the ability to use military action if Iran seeks to obtain a nuclear weapon in violation of this deal.  The knowledge of the Iranian program gained through extensive inspections will improve the effectiveness of any such action.  And the clarity of Iran’s commitment to the world–in the first paragraph of the agreement–that it will never pursue nuclear weapons will make it easier to gain international support for military action should Iran violate this unequivocal pledge.

 

This deal does not solve all outstanding issues with an adversarial regime. In that sense, it is similar to the Nuclear Test Ban Treaty that President Kennedy negotiated with the Soviet Union in the midst of the Cold War.  Iran’s support for terrorism remains a major concern and we must increase efforts with our regional allies to counter those malign activities.  But, at the end of the day, this agreement is not about making an ally out of an adversary.  It is about denying an adversary a path to obtaining nuclear weapons.  This deal takes a nuclear weapons program that was on the verge of success and disables it for many years through peaceful diplomatic means with sufficient tools for the international community to verify whether Iran is meeting its commitments.   I hope this resolution might open the door to diplomatic discussion of other tough issues with Iran.

 

Monitoring this nuclear agreement, and countering Iran’s non-nuclear activity, will require great diligence by the U.S., our allies and the IAEA.  And there will be an important role for Congress in this ongoing work.  I look forward to working with my colleagues on measures to guarantee close supervision and enforcement of this deal. The work will be arduous, but is far preferable to allowing Iran to return to a march toward nuclear weapons.  It is also far preferable to any other alternative, including war.

  

VA GOP Wants to Fire Highly Qualified Female Supreme Court Justice, Replace with Jesse Helms Pick

Seriously, you can’t make this stuff up. As we heard yesterday, “Virginians are used to hyper political temper tantrums from Virginia Republicans like Tommy Norment and Bill Howell, but their dark of the night announcement that they will be kicking a qualified, nonpartisan female justice to the curb in favor of their hand-picked male alternative is a new low.

Namely, Virginia Republicans want to fire the highly qualiifed Judge Jane Marum Roush and replace her with…this guy (click on image to “embiggen” and to read how “National Right to Work Committee President Reed Larson Friday lauded U.S. Sen. Jesse Helms (R-N.C.) for recommending Rossie D. Alston Jr., a graduate of the North Carolina Central University School of Law to serve as general counsel of the National Labor Relations Board”). Also note that the “National Right to Work Committee,” where Alston worked, is a far-right-wing organization tied to ALEC (Speaker Bill Howell’s organization), the Koch brothers, Americans for Prosperity, etc., which is one of the “national leaders in the effort to destroy public and private sector unions by pushing anti-union legislation at the state and federal level and by bringing lawsuits.”

Yep, that’s the guy – a bitter enemy of workers’ rights to organize, a former favorite of arch segregationist and bigot Jesse Helms, etc.- who Republicans want to replace Judge Jane Marum Roush. And why? Two main reasons as far as I can tell: 1) to get a right wingnut on the Supreme Court; 2) to pressure Gov. McAuliffe on redistricting, maybe to extract some sort of leverage or whatever. Either way, it’s unacceptable.

P.S. I hear that Judge Roush – someone who, by the way, is admired by everyone – had to give up her judgeship to be appointed to the Supreme Court, so now she could be unemployed. The question is, why would Alston accept that?!?

Virginians are used to hyper political temper tantrums from Virginia Republicans like Tommy Norment and Bill Howell, but their dark of the night announcement that they will be kicking a qualified, nonpartisan female justice to the curb in favor of their hand-picked male alternative is a new low.  


Judge Jane Marum Roush is qualified (Republicans even concede that in their press release), she was recommended by Republican leaders like Dave Albo and Greg Habeeb, and she is already serving on the bench taking cases. 


“Given their history of respect and inclusion toward Virginia women, it is tough to think of a reason the party of transvaginal ultrasounds, banning birth control and fighting equal pay for equal work would fire a female justice in favor of a male pick,”said Morgan Finklestein, press secretary for the Democratic Party of Virginia. “This attack on a qualified and nonpartisan female jurist who is already on the bench is just the latest example of how far outside the mainstream Republicans are, particularly on issues that matter to Virginia women and their families.”

Jim Webb spreading rightwing lie about recruiting office shooting

Here’s the short version.

When the deranged nutcase opened fire on the Marine and Navy recruiting offices in Chattanooga, one of the Naval recruiters – LCDR Tim White – had his personal firearm with him and returned fire.

Now the rightwing bulls*** machine is filled with a story claiming the Navy is bringing charges against LCDR White. The claim IS NOT TRUE. Despite this, Jim Webb has now picked up on the lie and is demanding the charges — the non-existent charges, that is — be dropped.

Here we go again.
